(1) The investigating officer shall have the authority to conduct the departmental investigation by following the following procedure:--
(a) To take statements, to file written evidence and to issue subpoenas in the name of witnesses, etc. to exercise powers similar to those of the court.
(b) To understand the evidence in the case of the accused civil servant.
(c) To give an opportunity to the accused civil servant to cross-examine the witnesses and file evidence against the accusation.
(2) After completion of the investigation work as per sub-rule (1), the investigation officer shall submit a report to the authority having the authority to issue orders. In such a report, he has to file his judgment along with the reason for the punishment as well as the proof of what happened.
